I did some research. If the language in the executive order becomes state department policy, it will be the most restrictive in over 32 years.

The original policy of the state department on this topic was first introduced as Passport Bulletin 92-22 in 1992. It was revised in 2010 to expand the variety of medical attestations allowed and the credentials of those who could produce them. (No longer requiring that they come from an attending surgeon, for instance.) And then again in 2021 to remove the medical attestation requirement and allow the option to select an 'X' marker beginning in 2022.

Prior to 1992, gender changes also were allowed on passports for transgender folks, but the process was ad-hoc and undocumented.

The executive order signed today implies a policy more restrictive than that time too.

This is the beginning of this nonsense not the end. Using civil rights law to discriminate against trans people is certainly a creative approach to this evil. We’ll see over the next bit what this means but these orders are written to take their best shot at hurting trans folks the most. They are not written for any goal short of that.

So. On the scale of bad (1) to as bad as possible with a first day exec order (10) I’d rate this about an 8.

While TikTok has restored functionality for users who have downloaded the app already, app stores which would liable at a rate of $5k/download do not appear to be offering downloads or updates of any ByteDance apps.

TikTok has taken down their in app error message and is appearing to attempt to restart US service once their CDN endpoints begin serving traffic again.

TikTok announced that their service providers received sufficient assurances from the incoming administration that they won’t be prosecuted that they’re comfortable restarting traffic.

For those who aren’t aware the law doesn’t enforce a specific penalty on ByteDance or TikTok, the main penalty for is for app stores that allow the app to be downloaded on or after January 19th. The fine is set at $5,000. Per download.

TechCrunch’s reporting vs the source they linked to that actually went and found a real source to report on.

TechCrunch’s article says 700M people joined, which is three orders of magnitude higher than their source’s source.

Implying that over twice the population of the US and 8% of humans on earth signed up for Xiaohongshu without taking a moment to check what you’re writing is just wild.

Of course all we have are rumors. Anyone who knows wouldn’t be saying, but it’s plausible enough that I think everyone is aware of the possibility that the space we share won’t remain a shared space.

On the other hand there’s also rumors the app developers are spending their time adding easier translation in app. Which would be wildly useful to everyone (TikTok has this too and it works great) and also doesn’t necessarily sound like a group of developers about to separate their users.

So no one really knows.

There are already rumors floating around that this situation is not likely to last long. This probably isn’t much of a surprise but I think everyone is hoping somehow if everyone manages to be polite enough and vibe together hard enough that everything can just stay cool.

This is not really likely to meet the PRC requirements if people decide to notice, and is a shame for those who relied more on this community than those of us just poking around to say hi.

One of the more interesting and surprising things to me on Xiaohongshu/小红书/RedNote is it’s the first time it’s felt like I’ve been in a social network where Chinese PRC folks and Americans shared the same social network without walls between each other in a meaningful way. TikTok always walled off Americans from Douyin and vice versa.

It’s not like I’ve never interacted with Chinese folks on the Internet before but a lot of it has been through one side or the other crossing the firewall via VPN. On 小红书 the wall just isn’t there.

And it’s going… pretty well? Americans are a little disruptive by nature so an influx of Americans from TikTok hasn’t gone unnoticed, but for the most part Red Note users have welcomed new friends, posted tips, and Americans are dutifully paying their cat tax and helping with English homework.
