Hmmm, just spitballing, but if I follow that logical thread, the EO stipulates that NO ONE has biological sex, because no human can have the characteristic on which the stipulated differentiation is made.

This is, logically, comparable to Russell's famous "is the king of France bald?" problem - the utterance is grammatically sound, but no real-world situation corresponds to its referent, so it is impossible to answer yes/no accurately.
