@LMac1970

Or, use existing common law protections and rights abour "Reckless Endangerment".

There are options to expedite encouraging a move away from fossil fuel usage. Might be better to devote efforts to prosecuting existing, supportable case law.

New York, and other States are moving to press charges of #recklessendangerment against oil #companies and their #executives

https://www.citizen.org/news/new-report-big-oil-fossil-fuel-ceos-could-face-prosecution-for-reckless-endangerment/

“The 50-page report details admissible evidence, possible charges, and legal issues pertaining to a prosecution against Big Oil firms and CEOs under New York’s reckless endangerment statute for their role in causing climate-related extreme weather events.”

So in the context of one individual nation state.

[#]Australia also has State and Federal laws about reckless endangerment, and in this context they would mostly apply to State Resource Ministers, especially New South Wales, Queensland, South Australia and Western Australia. Along with the Federal Minister for Resources where the deposits are in Northern Territory and offshore locations not subject to State jurisdiction. They are the wholesalers of fossil fuel supplies to the industry that does the extraction, processing and market supply.

But similar framework would apply in countries like #Canada #usa possibly #brazil #mexico.

Any permitting of new or expanded #fossilfuel supply would be reckless endangerment, given the known health and property damages from actualised and intensifying climatic events. Like those which just affected #NorthCarolina and #Valencia and many, many other locations around the world over the past few years.

The charges of reckless endangerment also extend to those who are financing, insuring and investing in fossil fuel projects.

As reckless endangerment is a criminal offence, this would also mean any corporate board member of senior executive who was still advocating for or supporting ongoing or expanded supply of fossil fuels would not be a “fit and proper” person to be a corporate board member, company director or senior executive [at least in a publically listed company].

Anyone supporting ongoing subsidies for fossil fuels would also be culpable of reckless endangerment.

According to scientific models as well as projections by the International Energy Agency, nations must stop approving new #oil #gas and #coal projects if the world is to stay within relatively safe levels of atmospheric warming.

Mary Robinson, the former president of Ireland who is now an outspoken climate campaigner, blasted the estimated $7 trillion in subsidies that the International Monetary Fund says governments worldwide spent last year on oil and gas drilling. “We are subsidizing what is destroying us,” she said.

“Fossil Fuel Subsidies Surged to Record $7 Trillion

Scaling back subsidies would reduce #airpollution, generate revenue, and make a major contribution to slowing #climatechange

“The Biggest Fossil Fuel Subsidies Are Indirect, and Bigger Than Ever

Implicit #subsidies for #fossilfuels — the underpriced costs of their environmental effects — come to 5% of global GDP yet are difficult to rein in.”

I hope all this gives you some ideas.
