@emptywheel The important question is whether Smith's filing punctures Trump immunity arguments. Which, judging from Trump's Sturm und Drang on the subject means Smith did. There's not enough time for DOJ to prosecute Trump ahead of the election, but that was never in question. This sets up Trump's prosecution after it happens. I suspect the election will not go Trump's way, and that allows him to finally be held accountable for his crimes...
