I now understand China's plan to destroy US w/ #TikTok.

  1. Make popular app

  1. Get Congress to write a law that predictably forces it offline

  1. Get POTUS to sign it

  1. Get SCOTUS to say it's good

  1. Wait for US to elect new POTUS & induce him to tear down the rule of law to reverse the outcome.

To be clear, whatever your opinion of the law in question, endorsing the idea that the President can somehow "fix" the current situation, absent arranging for a sale, is to endorse lawlessness.

@Colarusso Yeah, but isn't it pretty much the same kind of "endorsing lawlessness" as the President telling the DEA to not enforce marijuana offenses, or the President having pardon power?

1/2 @louis not really. Pardons are explicitly legal. They're part of the system.

As for the marijuana analogy, that's a bit different too. Here it's better to think more about banks than dealers. The parties that are actually on the hook are Google and Apple. Under the law they can't list TikTok in their app stores w/o facing consequences, big $ consequences...

2/2 The statute of limitations goes beyond Trump's term. So, there's no way he can guarantee non-enforcement. Their GCs can't let them violate the law the same way big banks won't give loans to marijuana dealers, but unlike dealers and banks, TikTok can't really work w/o Google et al. There's no magic wand here absent selling TikTok.

Which is to say there's no "fix" absent selling that doesn't involve flagrant disregard for the law.
