WPEngine and Automattic have stipulated to a bare bones preliminary injunction allowing WPE access to public pages and they can submit security vulnerabilities, but Automattic still wants WPEngine blocked from password-protected functionality (Automattic would not agree to more) #WPE #WPEngine #Automattic

WPEngine asks for more: to prohibit Automattic from blocking WPEngine's access to password-protected functionality, to prohibit blocking WPEngine's access to its plugins (including ceasing the auto-migration to Automattic versions), from disclosing WPE customers, and requiring removal of the checkbox. #WPE #WPEngine #Automattic

And the court agreed with WPEngine that within 72 hours Automattic must restore WPEngine's access, remove the checkbox and remove the list of WPEngine customers https://storage.courtlistener.com/recap/gov.uscourts.cand.437474/gov.uscourts.cand.437474.64.0.pdf #MattMullenweg #WPEngine #WordPress #Automattic @LWN

For those who are interested in the legal stuff, #WPEngine likely to succeed on claim for intentional interference with contract. Irreparable harm, balance of hardships and public interest also all in favor of WPEngine. "Here, the public consequences of withholding injunctive relief are significant." #MattMullenweg #Automattic #Wordpress @LWN

And #WPEngine even won on the bond.

WordPress platforms beware (if you hadn't figured it out already): "Defendants characterize WPEngine’s harm as self-imposed because it built its business around a website 'that it had no contractual right to use'."

@pchestek @LWN this is a deeply bonkers recitation of facts and timeline

@luis_in_brief @LWN Bonkers in the sense of what Automattic/Mullenweg did, I assume? Not the court's opinion?

@pchestek @LWN mostly that, yes, and also that when the court puts it together it is very stark and straightforward

@pchestek @LWN not in a bad or inaccurate way, it’s just not at all hedged in the way judges can sometimes be when they’re unsure of themselves or the facts

@luis_in_brief @LWN I thought also demonstrated a good grasp of open source, didn't seem mystified by the concepts (as they sometimes are)

@pchestek @LWN yeah, fairly straightforward- though I didn’t love the discussion at p.37-38 that seems to imply without much analysis that opening up Wordpress, the blogging software, creates an obligation with relation to Wordpress.org, the plugin repository.

@pchestek @LWN which suggests that … posting through it on every platform know to posting-kind is Not Advisable

@luis_in_brief He certainly left no platform uninvolved! And doing it personally too. And vehemently. The animus was so palpable

@pchestek yeah, I suspect what ultimately does him in is the vehemence. Transforms this from “these are just the rough elbows of business, tough luck” to “lots of open source devs are now learning what tortious interference means”

@luis_in_brief Mullenweg gave them plenty of ammunition for intentional interference. Negligent interference is certainly a sketchy claim, but no question here that it was open, intentional, deliberate, admitted interference hoping to put WPE out of business. WPE says the extortion claim is stronger, I'll be curious to see. But this was a pretty killer claim

@pchestek how can WP survive this if Matt isn't ousted? I'm at a loss to understand why anyone would let one dude wreck a whole platform.
I haven't blogged in ages, but I did use WP a lot when I was. What do I say to people who ask me what platform to use? I think these days it'd be "Don't use WP until they get rid of Matt"
