not to defend any particular TOS but technically when you post anything to the fediverse you’re implying consent to copy and republish that copyrighted work, and for any number of instances to republish, modify (resizing and recompressing counts) display in different contexts etc.. that’s what federation is. that’s how it works.
A TOS that explicitly asks its users for the rights to do.., what all federated software does… it’s not shadey or grabby it’s covering their ass. Instagram and facebook and any other social media has the same terms; and the goal is the same: you’re posting your stuff not to a server that you yourself own but to someone else’s; to be copied to any number of others.

i am a little surprised the normally switched on crowd here doesn’t get that the federation as it has been existing, without such terms, has been built atop a legal powderkeg in which any person with the resources could post a picture of a puppy, let it go viral, then sue every instance for copyright infringement

I have no idea, but the network has been extremely casual about such possibilities and unfortunately adding legalise to hedge against such possibilities is gonna look like a big rights grab cos;; whether you thought deeply about it or not, by posting anything, all kinds of shit that you don’t think about could happen with your copyrighted works; copying, machine learning, archival, indexing for search- displaying it to people you don’t like; displaying it in apps you don’t like
all without asking your permission each time.
I find it funny if you implicitly allow that by using the software but get spooked when what you are actually allowing is spelled out in legalese

i understand why they made the choice but im not sure it was a good one. some sort of linked data feels more aligned with what users expect from a security standpoint, but it would probably have a poor user experience.
