Stop applying copyright logic to culture. Stop applying copyright logic to anything. Copyright sucks.

Patents suck equally.

Trademarks are fine, as a mark of genuinity. But trademarking whole colors or patterns, like how paw prints on clothing is trademarked by one single company (jack wolfskin), is as insane as copyright and patents and can go die in a fire along with those.

Let other people make paw print clothes, as long as they're not literally writing your brand name on it.

@LunaDragofelis i think the core idea of patents is good. like the idea of documenting knowledge and not have everywhere company trade secrets.

But yeah it has become very absurd in how they are used and what is patentable.

@nachtpfoetchen @LunaDragofelis

The core idea of patents is that nobody should be allowed to do a thing except this giant corporation. Basically, stifling the freedom of every individual on earth in the name of a government backed monopoly for a single corporation (or theoretically, individual).

Applied, as it often is, to medicine, Patents are a form of mass murder.

@Aknorals @LunaDragofelis idk, often enough the alternative is to like not make the recipe publice. i really think patents aren't the problem. The pharma companies coming through with their bs is the main culprit.

@nachtpfoetchen @LunaDragofelis Patents make it literally illegal to do research with intent manufacture or distribute an object. Universities can of course do free research for the patent monopoly holder, but telling every human on earth they aren't allowed to save lives by researching 3D printed biomechanical kidneys is the height of capitalist evil.

@nachtpfoetchen @LunaDragofelis I picked that example because it predates my mom going on dialysis after her kidney started failing, and still hasn't come out after 7 years of her on dialysis or the 5 months after her death.

Fuck patents. Every lawmaker that pushes them is a genocidal maniac and acts against them should be treated like stopping a mass shooter.

How many millions must die in the name of government backed monopolies? (typically on what's university funded research anyways)

@nachtpfoetchen @Aknorals trade secrets aren't any better than patents, you're right about that

but maybe companies should be required to both make their inventions public AND let others use it? Maybe in exchange for R&D funding, if one were to insist on keeping capitalism.

@LunaDragofelis @nachtpfoetchen I'm not sure trade secrets, absent government backing, can survive an open and free (both meanings) internet.

Like, I extremely doubt it.

Well there is so much proprietary software that thrives. 🤷‍♀️ i think thats basically trade secrets. And it thrives so hard that eu is trying to get some control with the DMA.

@nachtpfoetchen @LunaDragofelis I'm not saying proprietary software wouldn't exist at all without Copyright, but there's no way on earth it could have the same kind of presence without that form of government monopoly. Rather than back it on one side and weaken it on the other, it would be wiser to stop enforcing monopolies to begin with.

@LunaDragofelis @Aknorals but is the idea of a patent not like the opposite of enforcing a monopoly? Like h264 patent expire and then everyone can use it.

@nachtpfoetchen @LunaDragofelis Yeah, when the monopoly expires others can use it. Copyright is a "limited" monopoly of a lifetime, or a lifetime plus another lifetime, and patents are a monopoly that delay innovation by a generation.

But if they were never granted that monopoly, everyone would have their natural freedom to research, create, invent, and produce better things.

Like the Salk polio vaccine.

Or inversely, the adoption of the steam engine was delayed decades by patents.

@LunaDragofelis @Aknorals but like patents and copyright is not the same patents are limited in germany for example for just 20 years. This is way less then a lifetime.

@nachtpfoetchen @LunaDragofelis 20 years is literally a generation. My statement kept both forms of violently enforced monopoly separate.

Now, Copyright in software does have done bleed over (until recently, local McDonalds franchises weren't allowed to fix their own not-ice cream machines because the software is copyright), and there used to be a thing where software IP monopolies also tried to patent basic code functions, which is basically patenting math, but yeah, they're different.

@nachtpfoetchen @LunaDragofelis

Also, you are correct (and my original statment correctly says) that folks are only censored from innovating monopolized designs for "only" 20 years, but this is a matter of life and death.

Again, my mom DIED in the years that it took the monopolies to not further their technology. As it happens, dialysis centers are very profitable, so it's not outside the realm of possibility they are "investors" of the tech, and are delaying the product.
