Summary: Microsoft is in trouble, but Microsoft-funded media won’t say it like
that
THE XBox problems [1] (many layoffs there, even an_existential_crisis!) have
been mentioned in Daily Links already, as was the conflict between Microsoft
and its de facto subsidiary, ‘Open’ HEY HI.
‘Open’ HEY HI now says something to the effect of, our chatbot actually sucks,
don’t trust Microsoft-bribed media [2-3]. For those who don’t know, ‘Open’ HEY
HI is actually losing billions of dollars (this information is out there; it’s
not a secret, only a little suppressed!). Then there are the antitrust
obstacles [4], which are covered in the mainstream media [5-6]. So there are
growing tensions with ‘Open’ HEY HI [7] and with the US government [8] which
may have just doomed the ambitions of resurrecting the gaming business [9-12]
by buying another company.
Tough year for Microsoft, layoffs aside. █

Total deaths in England and Wales, by week. Source: UK government (ONS).
Summary: A lack of proper, independent investigation means that loads_of_people
die_needlessly and our governments don’t even wish to acknowledge that this is
happening (instead they censor doctors in Social Control Media such as YouTube,
exercising_social_control_over_people_and_suppressing_factual_speech, under the
guise of protecting us from “racism” or “misinformation”)
YESTERDAY we saw “COVID-19′s ‘Patients Zero’ May Have Been Wuhan Lab
Scientists, Report Finds” [1] and a BSD geek from Sydney, who got infected with
COVID-19 some months ago (he’s about my age and took it very hard), wrote about
“coffee smells” [2]. It’s widely known that COVID-19 impacts the senses of
small and taste, which are very closely connected.
COVID-19 is generally not a a subject we approach from a medical point of view
(my Ph.D. is in Medical Biophysics, albeit COVID-19 has nothing to do with it),
but it seems interesting that ‘free’ press is too timid to explore the origin
and true impact of this virus. Only an hour ago we mention Free Speech (lack of
it) in China and minutes ago we said TikTok is effectively a weapon. COVID-19
has had a massive impact on tech workers — including EPO examiners — and
earlier today some independent media in Hong Kong (China?) said [3] that “the
Hong Kong government lifted our Covid-19 state of emergency” (despite COVID-19
still spreading rapidly, especially in China this summer, based on press
reports).
My wife and I have managed to avoid this virus so far. We’ve been COVID-free
and hope to stay this way until “it’s over” (we exercise great care/
precautions), but given the general attitude of people it might not be feasible
for another 4 years.
I planned to resign from my job in 2019, but then COVID-19 happened and I
stayed until 2022. I now do Techrights from home and I’ve not attempted to find
another job.
We need Free Speech. We need answers. We need a freedom-respecting Internet. █

I noticed something when I was making coffee yesterday in our
kitchen. I ran the beans through the electric grinder, took the
lid off, and the smell transported me back to 2020.
At the height of Covid, before we had vaccines and we were
confined to home for weeks at a time, I substituted my morning
coffee shop run with brewing it at home. In a world that was
somehow uncertain yet tedious, I liked that I at least had
control over this one part of my life. I’d brew the coffee,
take it out to the balcony, set up the laptop, and repeat the
same day I’d had for weeks.

Last month, the Hong Kong government lifted our Covid-19 state
of emergency. A few weeks earlier, the World Health
Organization had declared the pandemic over as Covid becomes
endemic. These developments allow the government to focus on
urgent tasks of economic development and reengaging globally.

Outages⠀✐
Posted in Finance at 8:13 pm by Dr. Roy Schestowitz
Summary: Facebook/Fakebook, whose primary function is misleading a lot of
people, isn’t doing too well; now it goes offline, too
Social control media is collapsing this year (profit is a necessity; many
platforms operate at a loss and some always operated at a loss). Facebook/
Fakebook is no exception. We recently wrote about YouTube, Reddit, and Twitter.
Yesterday we wrote about Microsoft's_LinkedIn_shutting_down_entire_offices
(same as GitHub, which is proprietary social control media for code). We didn’t
forget Facebook/Fakebook. There’s also some clobbering at Facebook/Fakebook.
Don’t believe fake “valuations” (market cap) at Wall Street. Market
capitalisation of Spotify Technology, for instance, is said to be 30.94 billion
at the moment, but Spotify Technology is losing about a billion dollars per
year. Total debt on the balance sheet as of March 2023: $1.85_billion. Many
people “don’t think so” simply because they don’t know that and never bothered
checking. So they’re in debt, they’re losing a lot of money, and somehow
they’re “worth” over 30 billion dollars? Like Twitter was “worth” 44 billion
dollars despite having about 13 billion dollars in debt while operating at a
loss?
🄸🄼🄰🄶🄴_🄳🄴🅂🄲🅁🄸🄿🅃🄸🄾🄽_⦇Spotify_|_SPOT_-_Debt⦈_
“It’s hard to tell for sure that there will even be a thing called “Facebook” 5
years from now.”What also matters is inertia or trends. The Web was abuzz some
days ago with “Facebook fading” [1] and “Facebook Papers” [2]. Facebook is now
dishing out some cash to entice people not to leave [3] and there are attempts
to get children “hooked” [4] (yes, Facebook is like a drug dealer). A lot of
Facebook staff left in recent years, not just because of the layoffs. Many
people resigned. Outages were reported a couple of days ago [5] (brain drain
always leads to this) and it’s starting to look like a Twitter-type collapse.
Just like Twitter, Facebook is a prime source of misinformation (see “Pitt
Cheung was scrolling through Facebook one Friday evening when he saw a post by
a local media outlet” [6]; it was false). There are also fakes being spread in
Facebook, as noted this past Thursday [7].
Facebook/Fakebook has no viable plan. VR headsets aren’t it. They just cost the
company a fortune and it went nowhere. It’s hard to tell for sure that there
will even be a thing called “Facebook” 5 years from now. █

Posted in Deception, Free/Libre_Software at 10:56 am by Dr. Roy Schestowitz
Summary: Free Speech needs to be protected, but people who attack the Free
Software Movement do not agree
YESTERDAY our long-timer (15 years!) Ryan Farmer wrote about Matthew Garrett
[1], berating him for attacking the American First Amendment after he had
become a naturalised US citizen. Mr. Farmer had accused him in IRC some days
ago of moreover committing perjury by doing so. While we don’t want to go into
all the gory details (it’s a rather long post that cites Techrights IRC a lot),
we thought it would be a suitable time to bring up Free Speech and cite some
examples from the past week.
Techrights not only believes in Free Speech (yes, capitalised!) but relies on
it. We criticise many powerful companies and if we were based in Russia or
China, we’d probably have been raided by now based on some false pretext (like
some drugs planted in the home or something related to taxes, “insulting the
leader”, “discrediting the state” etc.).
In this post I don’t want to berate Matthew Garrett (arrogant person, terrible
person by the way!) or interpret what his sick mind compels him to say. Instead
I’ll focus on new examples of what happens in countries that lack Free Speech.
Daniel Ellsberg has just died. It was expected because of a cancer diagnosis,
but I found out about his death only minutes after I said in IRC that he could
die any day, even “tomorrow” (I then checked what he was up to and found out he
had in fact died hours earlier!). Project Censored paid a tribute to him (we’ll
included many more in the next batch of Daily Links), citing [2] “part on an
interview with Project Censored’s Mickey Huff and Peter Phillips on KPFA,
Pacifica Free Speech Radio, The Project Censored Show, April 3, 2013.”
Ellsberg used Free Speech to stop a war. The general consensus in the US is
that he did the right thing, the moral thing, the necessary thing.
“Ellsberg used freedom of the press more than individual Free Speech,” an
associate has noten, “there was even a major court case as the result.”
Now fast-forward about half a century. Axios reported yesterday [3] that
“Department of Justice probe finds pattern of racist policing, excessive force
in Minneapolis”, stating: “Violated free speech rights of protestors and
members of the press, including by physically retaliating against people
engaging in protected speech.”
You see where this is going? So Matthew Garrett, who pretends to be against
police violence, is in fact enabling it. He’s attacking Free Speech. He regrets
Free Speech. He wants to take it away (see examples in Mr. Farmer’s post).
Yesterday there was also a new article [4] in the Journal of Free Speech Law.
There were many of those recently. Try to overcome the left/right wing barrier
and focus on the core issues. Many people are too infantile to do this. Even
voting machines’ integrity seems to have become a ‘wing’ thing [1, 2]. That
same journal published “Noisy Speech Externalities,” by Prof. Gus Hurwitz, just
3 days ago [5]. These aren’t a bunch of cranks but rather a professor or many
professors with a grasp of history and why Free Speech matters, even if it can
sometimes be misused as a shield by rather terrible people to say rather
terrible things. █

Editor’s Note: The late Daniel Ellsberg’s article, “On Civil
Courage and its Punishments,” was originally published in

Summary: Team UPC (the illegal and unconstitutional kangaroo court, Unified
Patent Court) and EPO thugs are trying to “buy the narrative” — a false
narrative of course, but courts and tribunals not yet absorbed by these thugs
are throwing out patents in large quantities, even in 2023
Dennis Crouch says that the U.S. Patent and Trademark Office (USPTO) is
“establishing satellite offices” and is planning to have another one [1] while
Crouch at al moan about fake US patents being squashed [2]. Obviousness is law
and fact, not either or…
The CCIA’s patent reformers meanwhile speak [3] of “non-practicing entity
(NPE)”, i.e. trolls, and Unified Patent continues squashing US patents, most of
them covering software [4-6]. There are financial rewards for those who help do
this [5] ($2,000). Unified Patent also has some good news [7] about a truly
monstrous troll, InterDigital, which we used to write a lot about.
A propaganda apparatus of the EPO dictators (Benoît_Battistelli, António
Campinos and their cronies), as well as a sponsored promoter of illegal agenda
(the Unified Patent Court, no connection to Unified Patent), has meanwhile
announced [8] that there’s “FRAND negotiation in Germany”. Like IAM (right now
at the top of the front page), they’re promoting monopolies under the false
guise of being “fair, “reasonable”, and anything but discriminatory. European
software_patents are often disguised under this blanket (or “thicket”) of
“FRAND. We certainly hope that EPO staff recognises JUVE for what_it_truly
became_in_recent_years — it’s just a ‘German IAM’, i.e. a mouthpiece of the EPO
with German connections. █
Related/contextual items from the news:
The USPTO began establishing satellite offices a decade ago to
expand beyond the traditional Alexandria (Washington DC)
headquarters. We now have offices in Detroit, Dallas, Denver,
and San Jose. Last year, Congress voted to further expand the
decentralization by at least one more. The Unleashing American
Innovators Act of 2022 (UAIA) mandates creation of a Southeast
Regional Office (SERO). The USPTO is now seeking comments on
where the office should be located — and the methodology it
should use in selecting a location. [Fed Reg].
The statute requires that it be located in Virginia, North
Carolina, South Carolina, Georgia, Florida, Tennessee, Alabama,
Mississippi, Louisiana, or Arkansas. I would automatically
rule-out Virginia and North Carolina as too close to the PTO
HQ; and also rule-out Arkansas as too close to the Dallas
Office. In my mind, I quickly narrowed things down to four
potential cities: Atlanta, Jacksonville, Miami, and Nashville.
Roku’s recently filed en banc petition begins with an
intriguing statement: “What should have been a garden-variety
substantial-evidence appeal has produced a dangerous
obviousness precedent—one as far-reaching as it is misguided.”
[Roku, Inc. v. Universal Electronics, Inc., Docket No. 22-01058
(Fed. Cir.) (en banc petition)]
An every day part of patent practice is arguing about whether a
cited prior art reference teaches a particular claim
limitation. That analysis is not always an easy task because
prior art is often quite cryptic as are the patent claims being
evaluated. One way to look at the process is an interpreting
of the prior art to see if it teaches the claim. In that form,
the process is seen a question of fact that must be based upon
substantial evidence and reviewed with deference on appeal.
When my business was sued for patent infringement, I was caught
off guard. In my case, we happened to be the target of a
baseless lawsuit from a larger competitor, but for many
businesses in a similar situation, the lawsuit comes from a
non-practicing entity (NPE).

Summary: It is becoming increasingly safe to predict the irreversible demise of
Reddit; give it a few weeks and watch how regulars of Reddit — not just
longtime moderators — become Web refugees, looking for a new place. Maybe a few
of them will explore self-hosting and even Gemini.
OVER the years we wrote a lot about bad sides of Reddit, seeing since 2006 or
since 2007 (Reddit was full of Novell shills) that it was dominated by
malicious corporations, moderated by liars, recklessly lying about its own
history, and even hiding sponsors like Microsoft. Reddit is a censorship site,
controlled by sponsors via volunteers, pretending to be a community. No wonder
Microsoft chatbots are trained on Reddit data; the “truth” there is already
curated by Microsoft and it omits Microsoft critics, among many other critics.
For those who’ve been living under a rock somewhere, Reddit is having a crisis
because its arrogant CEO refuses to acknowledge a mistake [1], he’s now
spamming countless journalists via NPR (yes, NPR spammed me by using their
Microsoft E-mail system!), and locking moderators out [2]. Even the mainstream
media covered this yesterday [3]. It’s no longer a one-day strike but something
vastly bigger. In Gemini, people_debate_alternatives_to_Reddit_(including
Gemini). The latest episode from Jupiter Broadcasting (Self-Hosted) covers it
[4]. It’s spinning out of control. Even 3 days ago it was already called
“Reddit Blackout” [5] and users, not just moderators, were impacted. There were
downtimes too.
Two days ago we saw reports that the “company won’t budge” [6] (they seem to
lack an understanding of who’s truly in control, not over the computer systems
but the fake community) and Jupiter Broadcasting’s Coder Radio said [7] three
days ago that “the ridiculous situation Reddit has created for itself and the
weak position of app developers.”
Ervin, a Free software developer, said [8]: “Another centralized tool for
communication going down the drain. I wonder what the IPO will look like in
this case.”
Yes, another. It seems like a trend. █
Related/contextual items from the news:
Enough_Money_From_Reddit_Users⠀⇛
Steve Huffman, the CEO of Reddit, has decided to just keep on
talking. After his disastrous AMA helped inspire more
subreddits to join a 48 hour blackout, and his dismissal of the
protesting subreddits as something not worth paying attention
to resulted in many subreddits extending their protests
indefinitely, Huffman apparently thought it would make sense to
go do a bunch of interviews and insult the protesting mods some
more. We’ll start with the interview he did with NPR which is
just dripping with entitlement.
Verge⠀⇛
Social platforms are entering a strange and uncertain future.
We dive into Lemmy, a self-hosted Reddit alternative. Plus, a
couple of easy-to-deploy tools that make life better.
Almost 8,000 subreddit forums calls for a Reddit Blackout to
protest against the latest pricing policy that will charge
third-party developers for accessing APIs [...]

Nobody cleans a house as quickly and as thoroughly as a
gentleman who has a ladyfriend coming over. Or something like
that, goes the saying. As the man cleans the house, he is

We chew on the ridiculous situation Reddit has created for
itself and the weak position of app developers.

Smart People vs SpyHome
Creative Commons Attribution-No Derivative Works 4.0
http://techrights.org/videos/renting-the-home-you-own.webm
Summary: There’s a renewed discussion or debate about so-called “smarthomes”
(SpyHomes) because some gullible Microsofter put ‘smart’ things all over his
own home and his own devices stopped working due to alleged racism
THE concept of a “smarthome” (SpyHome) was rarely covered here before, except
perhaps in passing. Due to this_story, however, the downsides were mentioned a
lot over the past few days. People now realise they don’t really control their
own homes if they are “smart”, i.e. remotely controlled by companies and
governments.
To quote The Register (two days ago):
“This wasn’t just a simple inconvenience, though,” he wrote. “I have
a smart home, and my primary means of interfacing with all the
devices and automations is through Amazon Echo devices via Alexa.
This incident left me with a house full of unresponsive devices, a
silent Alexa, and a lot of questions.”
Jackson’s smart home wasn’t entirely non-functional during this
period. Most of his smart home gear, he said, is self-hosted locally,
via Apple HomeKit, and not tied to an Amazon cloud service. He could
still interact with some devices through Apple’s Siri assistant
software.
Jackson attributes the suspension of his Amazon account – which
controls his Echo hardware and Alexa software – to an Amazon driver
misinterpreting an automated Eufy doorbell audio message.
“It is an object lesson in ownership,” an associate has told us about this,
“and if you don’t control the code you don’t control the machine. And, as RMS
has pointed out for decades, if you don’t control the machine, it controls you.
It’s a very important article in that way. Rossmann did a video about it, but
writing is 1000% more useful in documenting the problem and identifying the
solution (software freedom).”
So I’ve decided to do a video response to his video, followed by some text.
“I’d recommend listening to Rossmann’s pro-software freedom arguments in that
video,” the associate insists.
The video above is over half an hour long, but the gist of it is that companies
can take over all “smart” things in your home. Heck, not only “GAFAM” can do
this; the ISP can also sabotage your home, e.g. ahead of a home raid. Last year
we saw alarming stories about energy suppliers taking over (remotely) people’s
appliances and controlling thermostats.
As the video above points out, some “old” or “dumb” things give a lot more
control and freedom to the person who lives inside the home. Let’s make it a
trend to hold onto “traditional” appliances. Newer is not always better, except
perhaps to powerful people who want us to rent, not own, everything in our
lives. While mainstream media makes a lot of noise this year about buzzwords as
an existential crisis it seems to be missing or ignoring more immediate, not
hypothetical, threats. █

We need some more Free software to help find the news which matters (or pages
that matter, e.g. release pages)
🄸🄼🄰🄶🄴_🄳🄴🅂🄲🅁🄸🄿🅃🄸🄾🄽_⦇R.R.R.R.R.⦈_
R.R.R.R.R., one tool used for curation, developed earlier this year
Summary: Finding important and meaningful news on the World Wide Web (or even
Gemini) is hard and very time-consuming an activity; we need better tools for
the task and we’ve been developing some (even with graphical user interfaces)
Techrights put on pause some of its news curation activity this past Tuesday.
The reason? The signal-to-noise (s/n) ratio in the news (the rate of adequate
journalism rather than “filler”) is too low. In some cases, for some domains,
for every real news story there would be 5-10 SPAM items, either some sponsored
fodder or sales disguised as an ‘article’. Yet worse, a lot of deliberate
misinformation, i.e. disinformation, is being published. This can harm people’s
mental health and embolden extremist worldviews. The extent of this problem is
unprecedented. We’ve seen domains that, instead of going offline with some
dignity, simply became spamfarms (for money). Even some former “LINUX” sites
have become exclusively spam. A few of them actively promote the opposite of
Linux. The situation is barely tenable as it seems to be further aggravated
each week in every way. The deterioration is continuous and any prospects of
amelioration require a lot of manual work, such as filtering and curation. It’s
a lot of work. It’s more and more work each month if not every week. It’ll get
worse over time.
“It might take only 30 minutes per day to trot through every worthy coverage of
GNU/Linux issues on the World Wide Web.”This sentiment is shared among several
of us. Three months ago we_focused_on_developing_some_tools_for_curation, but
even those tools are now challenged by a really awful s/n ratio. Since the site
OpenSource.com was shut down (IBM made some face-saving excuses two months
later because we had chastised them for it), several more “LINUX” sites became
SPAM (or worse), and even finding an adequate number/quality of news about GNU/
Linux is no longer easy. It might take only 30 minutes per day to trot through
every worthy coverage of GNU/Linux issues on the World Wide Web. Gemini is
growing, but it’s still nowhere near the magnitude of the Web.
We must thus carefully reconsider how we curate and bring you Daily Links. The
Daily Links turned_15_not_too_long_ago (this past February) and we have no
intention of stopping them (we_recently_expanded_them_to_Gemini/Gopher). The
question is, how can we do this more effectively? Please feel free to contact
us via E-mail or IRC. Any suggestions can help us help you (with Daily Links).
We may spend the next few days focusing some more on deep thinking and coding.

Summary: Many people believe — or get paid to say — that TikTok is no worse
than social control media made by the West and controlled by the West; those
people clearly have no clue about TikTok (where_the_stated_aim_is_harm, it is
not merely a side effect)
TikTok is, bluntly speaking, a Chinese weapon disguised as an “app” or “site”.
Consider some recent examples such as [1] (some idiot “arrives at his own
funeral in helicopter after faking his death”). As we noted some days ago in
the series about YouTube, this imperils emergency services, can cause a
suicide, etc. What healthy-minded person does this? And what for? To teach
one’s family a “lesson”? See “Paramedics turn on premier in TikTok tirade” [2],
“The Battle for Control” [3] (yes, it’s about TikTok), and then witness
disturbing trends [4]. Even German media [5] has had its say.
For those who do not know what ByteDance is, Wikipedia says this: “ByteDance
Ltd. (Chinese: 字节跳动; pinyin: Zìjié Tiàodòng) is a Chinese internet technology
company headquartered in Beijing and incorporated in the Cayman Islands.” Well,
“internet technology” is a typo (should be capitalised i, but Wikipedia is no
longer known for quality) and calling it “internet technology” is a gross
understatement. It’s a surveillance giant that farms behaviour. It’s like a
Chinese “profiling” or “scoring” system for the entire world, operated by
youths for the most part but aimed at adults.
Yesterday the New York Times wrote [6]: “On the short-form video app, long-
established facts about the 1912 disaster at sea are being newly litigated as
musty rumors merge with fresh misinformation and manipulated content.”
Yes, “misinformation and manipulated content” is very common there because it
is actively being encouraged and promoted (selected to go viral, by hostile
forces). It harms people’s safety, feelings, self-image, and education.
Techrights has been consistently_and_unapologetically_against_TikTok, more so
than any other social control media. If you know someone who uses TikTok, do
your best to wean them/him/her off it. █

Summary: It is perfectly plausible that Twitter will declare bankruptcy not too
long from now; the company is not viable and things become very messy very fast
OUR position on Twitter has been all along very consistent. We’ve urged people
to quit the platform and not take anything found on that platform seriously (it
was a leading source of misinformation).
There’s some real news about Twitter these days. Below is a sample from the
past week.
Twitter is not a social network, nor is it a community. It’s an ego/vanity
project of Elon Musk, according to its CEO [1]. “Twitter’s Lawyers Admit
They’re Overwhelmed As Nearly 2000 Laid Off Employees File Arbitration Claims
[2] says a new article and now they need to worry about a lawsuit over
“copyright infringement to the tune of $250 million” [3]. The Twitter platform
of the present has a severe problem with fakes (changing what “verified” means
did not help) [4], which may lead to defamation lawsuits and accountability
lawsuits some down the line, and the founder of Twitter is trying to take
advantage of the chaos [5]. Musk seems to be thinking Twitter will become
another TikTok [6], but he’s late to the game and what’s left of Twitter is
being evicted for failing to pay bills [7-8]. Maybe soon the Web site and “app”
will go offline for failing to pay server bills [9]. No kidding here, this can
actually happen soon.
So what has Musk got in mind? Bringing in racists [10] and truly pissing off
LGBTQ users [11-12]? You just know this won’t end up very well. Openly
endorsing homophobic politicians in Twitter livestreams probably pisses off the
lion’s share of what’s left of the users in it, not to mention most US
politicians. “Jack Dorsey Says Indian Officials Raided Twitter Employees’
Homes,” said a recent article [13] and maybe some time soon it’ll be US
officials doing the same.
We’re not too sure what Twitter will look like by Christmas. Given all those
lawsuits and unpaid bills, the platform might as well be offline.
As noted in the title, the company still costs a huge amount of money to run.
The only way to put an end to these losses is to declare bankruptcy. █

and much more time intensive court process. However, lots of
big businesses became obsessed with the concept as well, and,
as we’ve covered over the years, that’s resulted in them
spending much of the early 2000s turning the system to their
advantage.

Summary: The sordid ploy to construct a bunch of unlawful kangaroo courts for
patents (even in unauthorised sites, contrary to the Unified Patent Court
Agreement) will not only destroy the European Union’s (EU) credibility on “law
and order” or “the rule of law” (they’ve had the audacity to lecture Poland on
that; Poland seems like the only country which bothered doing an economic study
on the matter, resulting in rejection of the Unified Patent Court); it
discredits the patent system as a whole and no amount of bribed “publishers”
can correct this
THIS won’t end well. We’ve said it for years already. There are reportedly many
“unitary effect” opt-outs, perhaps because many parties expect it to be some
temporary charade.
Some time earlier this month a bribed mouthpiece of Team UPC did some hilarious
reputation laundering article for ‘judge’ Grabinski. They fell all over
themselves to say he had no biases. What a joke! He months earlier he did photo
ops with the EPO‘s António_Campinos, a friend of Benoît_Battistelli, and when I
shared those photo in this site core people of the “conspiracy” (Team UPC)
contacted me and threatened me with litigation. These are gangsters, not
judges. They’re like a mafia pushing European_software_patents for the sake of
money. Follow the money… even JUVE cannot deny where the money came from, not
too long before those Grabinski puff pieces.
If the EU (and EC) cannot rectify the matter, this corruption will spread so
deeply to the EU (and EUIPO) that they too will collapse, with staff exodus or
staff revolting, even engaging in long strikes.
“If the EU (and EC) cannot rectify the matter, this corruption will spread so
deeply to the EU (and EUIPO) that they too will collapse, with staff exodus or
staff revolting, even engaging in long strikes.”“Three technically qualified
judges (TQJ) have resigned prior to the start of operations of the Unified
Patent Court,” Team UPC now admits [1] while Team UPC is just parroting the
propaganda from gangsters at the EPO [2]. What on Earth is going on here? “Law”
firms openly promote illegal things, citing actual criminals who operate with
impunity! How on Earth will that help the EU?
In better news, Unified Patent (no connected to the UPC) awards money to disarm
a patent troll which attacked GNU/Linux some years ago (Leigh M. Rothschild)
[3] and it challenges some other ludicrous patents as well [4]. Well,
occasionally it targets European Patents, seeing that at the Patent Trial and
Appeal Board (PTAB) inter partes reviews (IPRs) may get harder to initiate due
to the Microsoft mole who currently acts as Director of the U.S. Patent and
Trademark Office (USPTO). We hope that Unified Patent will expand in Europe and
do a lot more to tackle the injustice here, especially the fake patents’
pandemic.
“It won’t shock us if more UPC judges do the right thing and resign.”In other
patent news/noise, the patent maximalists are again conflating patents with
“Innovation” [5]. Florian Müller is back_to_lobbying_for_Microsoft and other
nefarious entities [6-7], and Patent Docs seems to have devolved into a
marketing ‘spam’ site [8-11], with the occasional real ‘article’ [12], pushing
their usual agenda. As Techrights put it this morning in IRC: “Wow! A lot of
PATENT ‘news’ sites are LITERALLY dying. Completely. Some barely publish
anything. This is a graveyard.” The EPO’s mouthpiece, JUVE, keeps lobbying on
FRAND [13] (hardly journalism, it is sponsored agenda-pushing) and Müller is
almost certainly (I’d say definitely) back on Microsoft’s payroll again, based
on his latest junk [13-15].
News about patents has never been this pathetic and misleading. JUVE has become
a judge’s reputation laundering agency. It won’t shock us if more UPC judges do
the right thing and resign. Have some self respect and dignity. █

A new PATROLL contest, with a $2,000 cash prize, was added
seeking prior art on at least claim 1 of U.S._Patent_8,651,369,
owned by Symbology Innovations, a Leigh M. Rothschild entity.
The ‘369 patent generally relates to enabling a portable
electronic device to retrieve information about an object when
the object’s symbology, e.g., a barcode, is detected. The
patent has been asserted over 100 times but most recently
against BrandsMart, Keurig_Dr._Pepper, and ADT.
The contest will expire on July 31, 2023. Please visit PATROLL
for more information and to submit an entry for this contest.
On June 13, 2023, Unified Patents filed an ex parte
reexamination proceeding against U.S._Patent_11,522,756, owned
and asserted by HyperX Networks, LLC. The ‘756 patent relates
to zero-touch provisioning systems and methods, and had been
asserted against Ciena.
View district_court_litigations_by_HyperX. Unified is
represented by Raghav_Bajaj at Haynes_Boone, and by in-house
counsel, Michelle_Aspen and Roshan_Mansinghani.
The patent system is a foundational part of the United States’
innovation ecosystem. The country created a national patent
system in 1789. While the patent system has evolved over 200
years, it has remained stagnant in one glaring way. The number
of inventors and patent professionals that are women or belong
to underrepresented racial and ethnic groups is alarmingly low
as compared to white men. While this disparity raises concerns
about inclusivity, it also raises the possibility that there
are untapped reservoirs of creativity and innovation within our
borders.

This differs from a normal DNS service in which Pi-

accept the resolved IP Address it returns.

‘Orion_Belt’_Linux_distro_now⠀⇛
If you are a fan of the Sparky Linux distribution,
I have some exciting news– version 7.0 is finally
available for download. This release is based on —
and fully compatible with — the Debian 12
“Bookworm” operating system. For users with ancient
hardware, Sparky 7.0 still provides support for x86
(32-bit) machines. But seriously, folks, just buy a
64-bit PC already…
By leveraging the stability and reliability of
Debian, Sparky 7.0 inherits a rock-solid base that
ensures a smooth and secure user experience. This
compatibility allows users to seamlessly access the
extensive Debian software repositories, opening up
a world of possibilities for software installations
and updates.
Keeping up with the latest developments in the
Linux ecosystem, Sparky 7.0 incorporates updated
packages from both the Debian “Bookworm” and Sparky
“Orion Belt” repositories as of June 15, 2023. This
commitment to package updates guarantees that users
have access to the most recent software versions,
bug fixes, and security patches, providing a secure
and up-to-date computing environment.
Sparky 7.0 comes equipped with the Linux kernel
6.1.27 LTS as the default option, ensuring
compatibility with a wide range of hardware
configurations. For users seeking bleeding-edge
features, kernel versions 6.3.8 and 5.15.117 LTS
are available in the Sparky unstable repositories.
This flexibility allows users to choose the kernel
that best suits their specific needs.

# ⚓ Ubuntu ☛ Security_maintenance_vs_support:_what’s_the
difference?⠀⇛
One of the most frequent questions we get during
conversations with our customers is “What’s the
difference between security maintenance and
support?” The word “support” has a wide range of
meanings and can be interpreted in different ways
depending on where it is used.
Especially in the open source landscape, the terms
“security maintenance” and “support” are often used
interchangeably, even if they represent distinct
aspects of protecting an organisation’s assets.
In this blog post, we will delve into the
differences and the synergy between security
maintenance and support, highlighting their unique
roles and importance in safeguarding our digital
environments.

Carmakers are facing numerous challenges on the
path towards software-defined vehicles (SDVs), such
as legacy vendor dependence, which is leading to a
lack of scalability, and high maintenance costs.
Adopting a software-centric approach should reduce
complexity and costs, accelerate time to market,
improve product quality, increase flexibility, and
provide more robust cybersecurity.
Carmakers need to fundamentally transform their
processes and organisational structures, focusing
on software development and services. Collaboration
between different departments, as well as external
entities, will be key in delivering exceptional
products and experiences to customers. This is what
highly competitive brands should be aiming for.

That’s it for the tools. Eventually, the

One of the things that we do every so often is put
together some little ‘web application’ that has to
be under some sort of access control or access
restrictions. Even today, CGI scripts remain the
easiest way to write and deploy a simple web

your choice and (with the right Apache
configuration) put it in an appropriate place with
an appropriate filename extension, and you’re done.
That leaves the access control.
o § Programming/Development⠀➾
# ⚓ Earthly ☛ Using_CMake_and_GCC_to_Cross-Compile_Binaries⠀⇛
Cross-compilation is the process of compiling your
program on a different host than the target system.
This enables developers to build binaries for
different architectures without using those
specific architectures themselves. For example,
with cross-compilation, you can compile a binary
for ARM-based devices like a Raspberry Pi on your
standard x86-64 development machine.
When cross-compiling your software, CMake and the
GNU Compiler Collection (GCC) can be helpful. CMake
is a robust build system generator that uses
configuration files to create cross-compiled
binaries, and GCC is a toolchain that includes
compilers for various programming languages,
including C, C++, Objective C, and Fortran.
In this tutorial, you’ll learn how to build a
simple C++ program and then cross-compile it for
AArch64 or ARM64-based devices using CMake and GCC.

licenses contradict the core principle of the open-

everyone, but it could also damage the
collaborative environment that’s been fundamental
to the open-source community’s ability to speed up
technological development.
There’s also a lot of doubt as to whether ethical
licenses will actually reduce the risk of code
being used for nefarious purposes. Many countries
already have human rights laws, and individuals or
organizations violating those laws should be
prosecuted accordingly, regardless of the method or
technology used to perpetrate the abuse. If such
laws do not deter these violators, then it’s
unlikely that a licensing agreement would have any
impact on the course of their actions.

Ellsberg angered the Nixon White House in 1971 when
he handed over documents from a top-secret report
about US involvement in Vietnam, from 1945 to 1967,
to the press.
He had worked on the report after being sent to
Saigon for the State Department. His Harvard
education as well as serving in the Marine Corps
and working at the Pentagon made him a top
candidate for the job.
But he had also become disillusioned by the war and
realized that the US could not win.
He began copying pages from the 7,000-page report
and eventually leaked it to The New York Times,
which published a first installment in 1971. This
unleashed the fury of the Nixon administration
which tried to block further publication.
This eventually resulted in a freedom-of-the-press
showdown at the Supreme Court that Nixon lost,
marking a turning point for the role of the media
in US life and politics.

The Pentagon Papers had been commissioned in 1967
by then-Defense Secretary Robert S. McNamara, a
leading public advocate of the war who wanted to
leave behind a comprehensive history of the U.S.
and Vietnam and to help his successors avoid the
kinds of mistakes he would only admit to long
after. The papers covered more than 20 years, from
France’s failed efforts at colonization in the
1940s and 1950s to the growing involvement of the
U.S., including the bombing raids and deployment of
hundreds of thousands of ground troops during
Lyndon Johnson’s administration. Ellsberg was among
those asked to work on the study, focusing on 1961,
when the newly-elected President John F. Kennedy
began adding advisers and support units.

Long before Edward Snowden and Wikileaks were

their government was capable of misleading and even
lying to them. In his later years Ellsberg would
become an advocate for whistleblowers and leakers
and his “Pentagon Papers” leak was portrayed in the
2017 movie “The Post.”
Ellsberg secretly went to the media in 1971 in
hopes of expediting the end of the Vietnam War. It
made him the target of a smear campaign by the
Nixon White House. Henry Kissinger, who was then
the president’s national security adviser, referred
to him as “the most dangerous man in America who
must be stopped at all costs.”
When he went to Saigon for the State Department in
the mid-1960s, Ellsberg had an impressive resume.
He had earned three degrees from Harvard, served in
the Marine Corps and worked at the Pentagon and the
RAND Corporation, the influential policy research
think tank.

# ⚓ Jacobin Magazine ☛ Daniel_Ellsberg,_American_Hero⠀⇛
Few people can say their actions helped to
strengthen press freedom, end a war, and bring down
a presidency. Daniel Ellsberg, who died today at
the age of ninety-two, did just that.
Ellsberg came to public prominence in 1971 when he
photocopied a secret history of US involvement in
the Vietnam War, what became known as the “Pentagon
Papers,” and gave a copy to the New York Times. The
New York Times’ decision to publish the papers set
off a landmark press freedom battle that went all
the way to the Supreme Court.
Ellsberg became the first whistleblower indicted
under the Espionage Act. In addition to seeking an
indictment, Richard Nixon also set up a “White
House Plumbers” unit to gather dirt on Ellsberg.
This unit would later be at the heart of the
Watergate scandal that resulted in Nixon’s
downfall.
# ⚓ Reason ☛ RIP_Daniel_Ellsberg,_Who_Told_the_World_the_Truth
About_the_Vietnam_War⠀⇛
“The only thing that I could personally hope to
achieve by my own efforts was to make these
documents available to the American public for them
to read and to learn from,” Ellsberg told Reason.
But he had a “very important secondary objective”:
halting what he saw as a dangerous trend of
“executive secrecy” that had allowed successive
presidents to “steal away so much power from the
Congress and the public and to free itself from the
kinds of checks and balances that were intended in
the Constitution.”
By giving those 7,000 pages to The New York Times
two years earlier, Ellsberg changed the course of a
war and shifted the American public’s view of the
presidency. He may not have succeeded in the larger
project of containing executive power, but he
earned a place in the whistleblower hall of fame:
one of a select few who, when entrusted with
damning secrets, recognized that his patriotic duty
was to tell the American people a difficult truth
their leaders would rather have kept hidden.

It’s tempting to view Ellsberg’s life, now that he

took. But the power of his memoir lies in its
recognition of how contingent his decisions were.
Ellsberg easily could have let others sacrifice to
end the war, convincing himself that he was more
valuable as an internal wrench in the war machine.
Enjoying continued respectability, bureaucratic
power, and technocratic prestige, Ellsberg could
have reconciled his opposition to Vietnam with the
broader thrust of US foreign policy, making it his
mission to temper the excesses of the Cold War.
After the Cold War, he might have made his peace

Ellsberg’s generation, and reaped the luxuries that

controversy.
It led to illegal countermeasures by the White
House to discredit Mr. Ellsberg, halt leaks of
government information and attack perceived
political enemies, forming a constellation of
crimes known as the Watergate scandal that led to
the disgrace and resignation of President Richard
M. Nixon.
And it set up a First Amendment confrontation
between the Nixon administration and The New York

denounced by the government as an act of espionage
that jeopardized national security. The U.S.

later the Nazis are not well liked and don’t have a

Letting them march is the lesser evil. It reminds
people that they’re there and they need to be

Of course there are repercussions in the United
States for being a Nazi, even though there is no

Nobody is going to elect you to anything.
In Germany, where there’s no strong freedom of

They’re in the legislature introducing bills and

Against that background, it’s disappointing
that the report doesn’t make the crucial
connection between many of the problems and
challenges that it identifies for future
development, and the outdated and harmful
nature of copyright in a digital world.
Although the word “copyright” is mentioned
eight times, it seems throughout to be
accepted as an inevitable part of the future
artistic landscape. As readers of Walled
Culture the book well know, that’s certainly
not the case. Not only is creativity possible
without copyright, but it is able to flourish
far better without the legal and economic
constraints born of copyright’s forlorn
obsession with controlling digital copies.

AI-only work is banned, but some music
created with AI help may qualify in certain
categories, the academy’s updated rulebook
reads. “A work that contains no human
authorship is not eligible in any
categories.”
Music creators must now contribute to at
least 20% of an album to earn a nomination.
In the past, any producer, songwriter,
engineer or featured artist on an album could
earn a nomination for album of the year, even
if the person had a small input.

emerged victorious in a long-running lawsuit
against pirate set-top box distributor Jadoo
TV. This week a California court granted
summary judgment, finding Jadoo TV and CEO
Sajid Sohail liable for direct, contributory,
and vicarious infringement. Personal
liability for Sohail is significant given
Jadoo TV’s ongoing bankruptcy proceedings.

Gemini is similar to the way the web was,
around 1993. Gemini feels to him as though it
is “devoid of human contact”. In this
connection he mentions measures such as
IndieAuth, feed aggregators and ActivityPub,
which complement the basic web stack, and
which afford some means of connection with
other users.
