●● 6 Years in Limbo After EPO Abuses Because ILO is Far Too Slow for Timely Justice (If Any at All)

Posted in Europe, Law, Patents at 11:27 am by Dr. Roy Schestowitz

“Sorry about your mistreatment, see you in the next decade!”

Summary: Union-busting and gross violations of labour law are unfortunately still not handled based on their substance in a timely fashion by ILO-AT (the ILO’s tribunal), which can sometimes take almost a decade to actually do something (whereupon it’s too late if not moot anyway)

THE failure of ILO to properly deal with European Patent Office (EPO) abuses against workers is noteworthy; the same can be said about member states and the EC. How can people like Battistelli get away with it all? Does Europe still have kings?

The other day I took out my frustration, seeing that one staff representative (former at least) had been stuck in the process for ages. One can only imagine how much money was spent, never mind the health implications. “King” Battistelli and his cronies have done unbelievable harm and ruined people’s lives by clearly violating the law and even their own rules. How can ILO not see this? This institution- (not staff-) friendly body acts as if money talks and rarely even speaks to any staff representatives of the institutions it ‘serves’. Here are some of the latest thoughts — if not pleas — from Dr. Koch. The decision is due very soon.

If my cases vs. the EPO were remanded to the EPO and "re-run" as internal appeals instead of being treated in substance by the ILO Administrative Tribunal, this would become a legal precedent for 58000 other civil servants or pensioners of 57 international organisations.#Art6ECHR https://t.co/oNPltMiX6F

While I very much appreciate any support for my legal position, I wish to emphasize that I did not authorise any articles or blogs on my cases against the EPO, nor did I even read them prior to publication. Thus the responsibility for their contents is solely with the author(s).

My cases AT5-4384 and AT5-4532 vs. the EPO have been pending for 6 years from the original decisions, see my related tweets of Jan. 8, 2020, with extensive written exchanges by both parties. https://t.co/78ZSMcd1kd

If the ILO Admin. Tribunal allowed the EPO's request, this would mean that an international organisation could effectively prevent its employees' access to a fair trial within reasonable time under #Article6ECHR. https://t.co/uUYjpYQWOn

If you are interested in my cases vs. the EPO and have a bit of time, you will find a summary in my tweets of 8 to 25 January 2020. Your support is welcome. https://t.co/XQN5hk4KhH

…and I repeat my respectful request to the @ILO #Administrative #Tribunal here: Please treat my cases no. AT5-4384 and AT5-4532 in substance(!), after 6 years of written proceedings since the original adverse decisions in 2013. https://t.co/s1Cnzmkj0c

Your (moral, legal) support of my request to the @ILO #Administrative_Tribunal would be welcome, especially if you are legally skilled. #Article6ECHR https://t.co/ttyi3ZzlJB

Please do not silently let my cases vs. the EPO become moot before the @ILO #AdministrativeTribunal. #Article6ECHR
— Dr. Anette Koch (@AnetteKoch) February 5, 2020
Please remember that my cases will become legal precedents for 58000 other civil servants or pensioners of 57 international organisations coming under the @ILO #AdministrativeTribunal's jurisdiction, see https://t.co/rHABRFZu5z #Article6ECHR https://t.co/xrNDfA2uso

Please expose and oppose #HumanRightsViolations whereever you see them, and pls always vote accordingly, to maintain the #ECHR and other legislation granting #HumanRights. #StopNeofascism https://t.co/f1UuVZTqLB

The @ILO #AdministrativeTribunal will deliver its Judgments on my cases AT5-4384 and AT5-4532 vs. the EPO on 10-2-2020 – could you please spread the word in your networks and make my Twitter network grow until then? Thx a lot. https://t.co/f1UuVZTqLB

Suffice to say, neither does she speak for us nor we speak for her. But she’s a rare case of appellants becoming vocal and one might say outspoken online. Hard to blame her. █
